Murray Energy workers’ compensation and black lung benefits

As you are aware, on October 29, Murray Energy filed for bankruptcy protection in the Bankruptcy Court for the Southern District of Ohio.  As part of the bankruptcy process, notices are being sent to Murray Energy’s creditors, explaining that they need to fill out “proof of claim” forms.

 

If you receive Workers’ Compensation and/or Black Lung benefits through Murray Energy (even if you did not work for Murray Energy) you are considered to be a “creditor” by the Bankruptcy Court.  If you have a personal lawsuit or other personal claims against Murray, you are also considered to be a “creditor” by the Bankruptcy Court.

The Bankruptcy Court has not recognized the UMWA as a representative for active employees who are currently receiving Workers’ Compensation benefits.  Similarly, the Bankruptcy Court has not recognized the UMWA as a representative for active employees who have personal lawsuits or other personal claims against Murray Energy.

However, on January 9, 2020, the Bankruptcy Court recognized the UMWA as a representative for Retirees who receive Workers’ Compensation or Black Lung benefits.

 

As a result, Retirees who are receiving either Workers’ Comp or Black Lung benefits have two options:

  • You may file your own proof of claim with the Bankruptcy Court, OR
  • You may submit your information to the UMWA Legal Department, and we will file a claim on your behalf. This information should include your:
  • Name
  • Address
  • Contact Information
  • Basis of Your Claim (either Workers’ Comp or Black Lung)
  • Amount of benefit you receive; and
  • Copy of your Workers’ Comp or Black Lung Award letter, if possible.

Submit this information to the UMWA Legal Department by February 28, 2020 to:

If you are receiving Workers’ Compensation or Black Lung benefits through Murray Energy and you wish to file your own claim with the Bankruptcy Court, or if you have a personal lawsuit or other personal claim against Murray Energy, please contact your attorney.  That attorney can assist you in filing a “proof of claim” with the Bankruptcy Court.
